Mubasher Financial Service BSC(C)’s agreement to serve customers through Online Customer Support Chatting Service:

This agreement contains important information on the obligations, rights, requirements, and privacy provided by Mubasher Financial Services BSC (C), an investment firm regulated by the Central Bank of Bahrain and having its registered office, at Unit 181, Platinum Tower, Building 190, Road 2803, Block 428, Al Seef District, Kingdom of Bahrain and whose Registered Number is 65077 (“MFS”).

Please read the below items and terms carefully:

Whereas this agreement is part of the free of charge services offered by MFS to its customers to facilitate trading, particularly to new traders on the stock market, the content of this agreement can be in no way considered an offer or a recommendation to buy or sell or petition for an offer to buy or sell any securities and/or other property or product or financial instrument or to participate in any particular trading strategy. The content of this agreement may not be explained nor any information provided through the service as an offer or a recommendation to buy or sell or petition for an offer to buy or sell any securities and/or other property or product or financial instrument or to participate in any particular trading strategy. The customer shall agree and declare once and for all that he/she shall not have any demands of any kind against MFS. The customer shall state that he/she is the sole person responsible for determining the suitable investment options for him/her in light of his/her personal or private circumstances. The customer shall be aware that MFS shall not be responsible for any decisions of this kind. As a self-directed uninfluenced investor, the customer shall bear full responsibility for any and all transactions carried out in the trading account in his/her favour, and in terms of investment strategies and decision related to him/her, the customer shall be aware and shall agree that MFS shall not bear responsibility of any kind for the results of the customer’s investment strategies, transactions and decisions. The customer shall declare his/her knowledge that in accordance with this agreement, he/she may not issue buy or sell orders or any other orders related to the customer’s cash portfolio account or stock portfolio account or take any action of any kind in the account through this service.

MFS shall not provide a guarantee of any kind regarding stocks or future performance thereof.

I (account owner) hereby declare that I am a customer of MFS and have agreed in advance to the terms and conditions of the MubasherTrade Trading Services Customer Agreement on the website of MFS and/or by reading and signing a printed copy as part of customer registration to create an account for myself (individually or in a group) or a corporate account with MFS I hereby agree that I shall read carefully and understand the terms and conditions of this agreement before pressing the “agree” button.

Should I have any questions regarding the terms and conditions stated in this agreement, I shall contact MFS on its hotline +973 17556139. I hereby agree to commit to the terms and conditions stated herein this agreement for the Online Customer Support Chatting Service. I understand that amendments may be made to this agreement from time to time by MFS and that amendments may be made to the terms and conditions published on the Company’s official website. In addition, I understand that I am agreeing automatically to any amendments to the agreement and the terms and conditions on the website as long as I continue to use the Online Customer Support Chatting Service without objection to the amended terms of this agreement as soon as the amended terms are published on MFS’s website and that the amended terms and conditions shall be binding on me.

Terms and Conditions:

1- Disclosures and Agreements

1-1 The customer hereby discloses that he/she has read carefully and understood this agreement and shall keep a copy of such for future reference. The customer is aware that this agreement binds all the aspects of the relationship with the customer after subscribing to the Online Customer Support Chatting Service provided by MFS provided that there is no contrary text in another agreement concluded between the customer and MFS and/or a subsidiary related thereto regarding a particular product or service.

1-2 The customer hereby discloses that MFS has the right to make amendments to this agreement at any time or to terminate the agreement at any time. The customer shall agree to consult with the MFS’s website on a regular basis to receive the most up-to-date information on the services, fees and costs related thereto and to be aware of the changes that may occur in this agreement.

1-3 MFS is entitled to terminate this agreement at any time for any reason according to its sole discretion.

2- Determining Responsibility:

2-1 The customer shall agree that MFS does not guarantee the completion or benefit or accuracy of any of the information provided as part of the Online Customer Support Chatting Service.
The customer is aware that MFS may at any time bar or ban any person from accessing its content.

2-2 The customer shall agree that to the extent permitted by the applicable laws, that directly or indirectly MFS and its officials, employees, shareholders, subsidiaries, branches, delegates and third party information providers and any other related parties linked to the Online Customer Support Chatting Service, shall not be responsible in any way for the decisions taken based on the content of the Online Customer Support Chatting Service by the customer or any other person using the service, and that the customer may not in any way use such content in the event of resorting to an external authority or entity as the customer is fully aware that such content has no worth when forming or taking an investment decision.

3- Complaints

In the event that the customer is dissatisfied with the service and wishes to submit a complaint or terminate the service, he/she must contact MFS via its hotline: +973 17556139.

4- Enforced Law

This agreement is subject to the laws of the Kingdom of Bahrain.

5- Agreement Summary

This agreement along with the agreement to provide trading services to the customer and other agreements (if available) that pertain to the trading account and that were previously agreed upon between the customer and MFS constitute the entire agreement between the customer and MFS.

6- Disclosure of Knowledge

This agreement shall be considered valid proof of the customer’s agreement to be bound legally thereto this agreement that regulates the relationship between the customer and MFS.

I understand that pressing “agree” is the legal equivalent to my actual signature to this agreement and shall result in binding me to this agreement.

I agree to commit to the terms and conditions stated therein this agreement.
